MOEV INC. ("MOEV") ENCOURAGES YOU TO READ ALL THE TERMS IN THIS AGREEMENT ("AGREEMENT") BEFORE ACCEPTING IT BY PRESSING AGREE. BY PRESSING "AGREE" YOU ARE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PRESS "CANCEL".
THIS IS A LEGAL AGREEMENT BETWEEN YOU (INTERCHANGEABLY CALLED "MOEV USER") AND MOEV INC. ("MOEV") STATING THE TERMS OF USAGE OF THE MOEV Driver TM APP AND REGULATES THE TERMS OF PARTICIPATION IN THE CHARGING OF ELECTRIC VEHICLES USING MOEV’S ELECTRIC VEHICLE CHARGERS ("MOEV CHARING SERVICES") OR THIRD-PARTY VENDOR CHARGERS. AMONG OTHER THINGS THE FOLLOWING AGREEMENT REGULATE MOEV'S COLLECTION OF DATA AND IS CREATED TO DEMONSTRATE THE COMMITMENT TO THE PRIVACY OF ITS CUSTOMERS AND USERS.
The MOEV agreement contains of the following sections:
Mission. MOEV's mission is to provide our users with personalized charging services using artificial intelligence and data collection for more energy effective and cost effective charging.
Customized EV charging. MOEV Driver TM offers our MOEV Users customized electric vehicle (EV) charging based on variables such as departure time, energy requirements, energy costs. MOEV Driver TM provides EV charging customers with the option of getting the cheapest cheapest energy, and the means to opt-in to their local utility’s incentivized offerings, such as making their EV a part of the demand response (DR) program. MOEV Driver TM can also allow for drivers to participate in solar or wind energy markets. Utilities that are offering services for mitigating the grid impacts of what CAISO (California Independent System Operator) calls a "duck curve", will be able to incentivize the EV drivers, via the MOEV Driver TM, to participate in, and benefit from, such innovative programs.
About the Agreement
You understand and agree that by creating a MOEV account you become a MOEV User. This does not mean that a legal partnership or agency relationship is created between you and MOEV.
This Agreement is void where prohibited by law and the right to register as an MOEV User is not granted in such jurisdictions.
MOEV claim the right to make changes and updates of the privacy policies in this Agreement and do therefore recommend you to continuously check the privacy terms for updates and changes. Your Commitments
You must be at least 18 years of age to register as a MOEV User
You must not be prohibited from receiving
You warrant that the information that you provide on the MOEV Driver TM is accurate and do not violate any third party rights. You, and not MOEV, is solely responsible for the content that has been made available through your login on the MOEV Driver TM.
You agree to keep your account updated to correspond to prevailing circumstances.
Collection of Information
MOEV collects and saves information to analyze and improve our services. In respect to MOEV Users, MOEV's data collection is limited to information necessary for identification and to fulfill our mission which is to provide our users with customized and personalized charging, including cost and energy usage optimization and utilization.
Information that you provide
MOEV collects and saves the data that you provide when signing up as a user for MOEV Driver TM app. Examples of requested information are car model, name, telephone number, and email account.
You might also be asked to provide MOEV with additional information while using the MOEV Driver TM app. In respect to MOEV Users, MOEV's data collection is limited to information necessary for identification and for optimizing the service provided to MOEV User.

Geographic Locations
MOEV autonomously collects and saves certain information about your general geographic location to provide you with customized and personalized charging
Demographics
MOEV autonomously collects and saves certain information about your charging demographics and charging behavior will using MOEV Driver TM. Examples of such information are data of charging stations and charging duration.
Charging Behavior
MOEV autonomously collects and saves certain information about your charging duration and time of charging station.
Cookies and Online Tracking
MOEV uses cookies and other online tracking technologies to operate and provide our Services to MOEV Users. We use cookies and other online tracking technologies to make it easy access our services by remembering you for the next time you visit our website or MOEV Driver TM
Third Party Sources
We may also collect information about you from business partners, analysts, and other third party sources to better customize our Services for you.
We may also collect information about you from credit reporting agencies to determine your creditworthiness..
Protection of your information
To help protect your privacy of the data that you transmit through MOEV's Service, MOEV uses industry standard secure software that encrypts the information you add before it is sent to us. However, MOEV cannot guarantee absolute security of your account or the personal information we collect, and we cannot guarantee that our security measures will prevent third-party attackers from illegally access the MOEV Driver TM app or any other breach of security in association with using MOEV Charging services.
Information Sharing
Program Partners such as Site Hosts & Utilities. MOEV will share aggregated MOEV Users' data to site hosts and utilities. The data sharing might also be done to provide governmental institutions with statistic information for research purposes and to other third parties including, but not limited to, auto manufacterers. The data mentioned in this paragraph is collected in aggregated form without identifying individual MOEV users.
Merger & Acquisition, Reorganization, and Restructuring. Information may be shared in the event of a merger, acquisition, reorganization, and restructuring, or any other form of sale of part or all of MOEV’s assets or business.
MOEV might also provide aggregated information to third parties for marketing and promotional purposes. In the case of providing third parties with aggregated data for marketing purposes, MOEV grantees that no information will be traceable to an individual MOEV user.
Contractors and other Service Providers. On occasion, MOEV might use other companies, agents, or contractors to provide you with MOEV’s Service. For example, we hire companies, agents, or contractors to provide MOEV with marketing, infrastructure, and IT services. In these situations, MOEV may disclose MOEV Users' aggregated information that is needed to provide you MOEV's Service or improve MOEV's Service. However, such contractors are prohibited from using the aggregated data for any other reasons than to provide MOEV with services.
Exceptional Cases. There are some exceptional cases in which MOEV might share your personal information to third parties in a way that might personally identify you. These cases are the:

Obligation by Law. MOEV may disclose your personal information In cases where MOEV is under legal obligation to disclose information for the purposes of to satisfy any applicable law, regulation national national security, law enforcement or other issues of public importance.
Insolvency. Should MOEV become insolvent, MOEV would be under no obligation to MOEV User to continue providing charging services or use of MOEV Driver TM.
Intellectual Property
By registering as a MOEV User, MOEV grants you a nonexclusive and revocable license to access and use the MOEV Driver TM and the the MOEV charging services. The MOEV Driver TM and the the MOEV charging services are available for non-commercial use only, which means that no MOEV User without a written permit from MOEV is allowed to sell, distribute, licence or in any other way exploit, in whole or in part 1. the MOEV Driver TM or 2. information and/or software associated with MOEV's charging services.
In relation to MOEV Users, MOEV retains ownership of all rights associated to the MOEV Driver TM and the software connected with MOEV’s charging services. No rights or licenses are granted or implied under any MOEV intellectual property.
You agree not to exploit the MOEV Driver TM by using it for other than authorized purposes, including but not limited to trespassing and burdening the network capacity. Furthermore, you are not allowed to decompile, reverse engineer, or attempt to derive the source code of the MOEV Driver TM or MOEV's charging services. Any activity to violate, tamper with, or circumvent the security of MOEV's software, passwords, encryption codes, technological protection measures or likewise is expressly prohibited.
Service Reservations
You understand and accept that since some of content that is made available on or through the MOEV Driver TM is third party content, MOEV cannot guarantee the accuracy of such content.
Service interruption
You understand and accept that your access to and use of the MOEV Driver TM may be disrupted in the occasion of an unanticipated or unscheduled downtime or for any reason that causes unavailability in part or in whole of the MOEV Driver TM , examples of causes that that could result in unavailability are power outages or system failures.
You agree that MOEV is entitled, without any liability to you, to disrupt access to the MOEV Driver TM, in part or as whole, at any time:
to take measures that permits MOEV to conduct maintenance or make modifications to the MOEV DRIVER TM; to protect our software, servers, services, and our MOEV Users from attacks, such as but not limited to, denial of service attack. MOEV has the right to, in our sole discretion, determine what constitutes such risk that lead us to disrupt the services in cases for when MOEV's services is prohibited by law or in other situations where MOEV determines to disrupt services for legal or regulatory reasons.
To the extent MOEV is able, MOEV will endeavor to post updates on the MOEV Driver TM, and through our other channels
MOEV shall have no liability whatsoever for any damage, liabilities, losses (including any loss of data or profits) or any other consequences that you may incur as a result of any Service Interruption.
Limitation of Liability
The MOEV Users agrees that MOEV shall not, in any event, be liable to the MOEV User, including but not limited to damages to vehicles, damages for loss of profits, goodwill use, data or other intangible losses that arises out of or in any manner connected with the use or or performance of the charging station. (don’t know if it’s even possible to renounce such responsibility)
Termination
You acknowledge and agree that MOEV, in its sole discretion, may suspend or terminate your account or any part thereof. Either Party may terminate this Agreement at any time and for any reason. As a MOEV User you cancel your account by request to: info@moevinc.com
